NIE & Residency

The Foreigner Identity Number (NIE) is the gateway to any legal, tax or property transaction in Spain. At Fau & Loustau Abogados we process the NIE, the EU citizen registration certificate, the TIE and the various residency authorisations for foreign nationals wishing to settle in Mojacar or on the Coast of Almeria.

Since the entry into force of Brexit, British citizens require differentiated treatment. We manage the renewal of the green card for residents established before 31 December 2020 covered by the Withdrawal Agreement, and we process initial residency authorisations for those arriving after that date, primarily the non-lucrative residence permit. We also assist with family reunification, modifications of residence status and renewals.

Frequently asked questions

What is the difference between the NIE, TIE and EU certificate?

The NIE is simply a tax identification number assigned to foreigners. The EU registration certificate is a green A4 document for EU citizens. The TIE is the physical card with a photograph that certifies legal residence for non-EU citizens, including British nationals post-Brexit.

I am British and was resident in Spain before Brexit. What should I do?

You should hold the TIE under the Withdrawal Agreement, which replaces the old green card. This card preserves your pre-Brexit rights. If you have not yet applied for it, we handle the process before the Immigration Office on your behalf.

How long does the NIE take?

An NIE requested for a single procedure can be obtained within a few days or weeks, depending on appointment availability in Almeria. We manage the appointment and documentation to shorten timescales as much as possible.

Can I obtain the NIE without travelling to Spain?

Yes. You can apply at the Spanish Consulate in your country of residence or through a notarial power of attorney granted to our firm, which allows the entire process to be completed without travelling.

What are the requirements for the non-lucrative residence permit for retirees?

You must demonstrate financial means of at least 400% of the IPREM (annual public income indicator), approximately 28,800 euros for 2025, plus an additional 100% for each family member. Private medical insurance with full coverage in Spain, a criminal record certificate and no entry ban into Spain are also required.
