Investment Visas and Residency

Since 3 April 2025, Organic Law 1/2025 has definitively abolished the Golden Visa for property investment in Spain, ending the residence permit that was granted to those who purchased property worth 500,000 euros or more. Applications submitted before that date continue to be processed under the previous legislation and permits already issued remain valid until their expiry.

Fau & Loustau Abogados advises foreign investors seeking to reside in Spain on the alternative routes currently available. The non-lucrative residence permit remains the most common option for retirees and those with independent means, requiring financial resources of 400% of the IPREM, approximately 28,800 euros per year for the main applicant. The Digital Nomad Visa, created by the Startups Act 2022, allows remote working for foreign companies from Spain with tax advantages. The Entrepreneur Visa is aimed at those presenting an innovative business project of interest to Spain.

We study each case individually to identify the most suitable route according to the client's profile, income, family situation and residency objectives. We process the complete file, from document preparation through to obtaining the TIE, for both the main applicant and their dependent family members.

Frequently asked questions

Can I still obtain the Golden Visa by buying a house in Mojacar?

No. Since 3 April 2025, Organic Law 1/2025 abolished the Golden Visa for property investment. Only applications submitted before that date are being processed. To reside in Spain there are other current alternatives such as the non-lucrative residence permit or the Digital Nomad Visa.

What happens to my Golden Visa if it was already granted?

Authorisations granted before 3 April 2025 remain fully valid until their expiry and may be renewed under the previous legislation. Our firm manages the renewals and modifications for existing Golden Visa holders.

What is the best alternative to the Golden Visa for a retired British national?

The non-lucrative residence permit is the most common option. It requires demonstrating passive income of 400% of the IPREM, approximately 28,800 euros per year for 2025, private medical insurance in Spain and a clean criminal record. It allows residence without working and is renewable.

Can I work in Spain with the Digital Nomad Visa?

Yes, but only for companies or clients outside Spain, with a limit of 20% of income from Spanish clients. A prior employment or professional relationship of at least three months and proof of sufficient income are required. It offers favourable tax treatment during the first years.

Should I apply for the special tax regime for inbound workers?

The regime known as the Beckham Law allows you to be taxed as a non-resident at 24% on the first 600,000 euros for six years. It is particularly advantageous for those coming to Spain with high employment income. We analyse each case individually to determine whether it is more beneficial than the standard IRPF regime.
